The employer will meet their obligations under the tier visa system. It is sometimes possible that a company will receive a zero allocation after obtaining a licence. If the employee fails to add this number to their application then it will be refused and the CoS will be invalid. Applicants can come to the UK with a Tier (Intra-company Transfer) visa for up to the maximum stay allowed for their visa type, or the time given on their certificate of sponsorship, whichever is shorter.

Tier 2 certificate of sponsorship

Once an NHS trust has offered you a job, you’ll need a Tier (General) Visa in order to work legally in the UK. For the hospital to receive a CoS, they must apply to the UK Visa and Immigration Department. This allows settled workers to apply for the vacancy. Under the current UK immigration system, unused Tier restricted CoS to employ people who are currently based outside the UK, can be reclaimed after three months.


Depending on the job a foreign employee will be performing in their business, the employer must require a sponsor license to issue certificates of sponsorship for either in Tier – skilled workers with long term contracts, or Tier – temporary workers with short-term. This increases the availability of restricted CoS.

The process for doing so will depend on whether they are applying outside the UK, or whether they are applying to extend their visa, change employer, or switch visas in the UK.
